PrettyFans Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the PrettyFans website, mobile experiences, and related services (collectively, the “Platform”). The Platform is operated by XYRA MEDIA TECHNOLOGIES LTD (also referred to as “PrettyFans,” “we,” “us,” or “our”).

By creating an account, browsing, subscribing, purchasing, uploading content, livestreaming, sending messages, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Definitions

Account means a registered user profile on the Platform.

Creator means a user who uploads Content and offers subscriptions, paid media, livestreams, tips, gifts, or other paid features.

Fan means a user who subscribes to or purchases Content from Creators.

Content means any text, images, audio, video, livestreams, messages, comments, links, metadata, and any other material posted, transmitted, or otherwise made available on the Platform.

Paid Content means Content that requires payment to access (including subscriptions, pay-per-view, locked media, paid messages, or paid livestream access).

Subscription means a recurring or fixed-term payment to access a Creator’s subscription feed or tiers.

Wallet / Balance means your stored value, credits, or earnings balance shown in your account.

Fees means Platform fees, processing fees, chargeback fees, and any applicable taxes or withholding.

Verification means identity and age verification, and where applicable Creator documentation requirements.

2. Eligibility, Age, and Account Rules

You must be at least 18 years old (or the age of majority in your location, whichever is higher) to use the Platform.

We may require identity and age verification at any time. If you fail verification, your access may be restricted or terminated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity on your Account.

You must provide accurate account information and keep it updated. Impersonation is not allowed.

We may limit or suspend Accounts for suspected fraud, policy violations, or security risks.

3. Platform Nature and Content Warning

The Platform supports creators across multiple categories. Some areas of the Platform may include adult content intended for consenting adults only. You agree not to access the Platform if you are underage or if adult content is illegal where you live.

4. Your Relationship With PrettyFans

PrettyFans provides a technology platform that enables Creators to publish Content and Fans to access Content.

Creators are responsible for their Content and for complying with all applicable laws and regulations.

Fans are responsible for how they use Content and for complying with these Terms and local laws.

PrettyFans is not a party to transactions between Fans and Creators, except as the platform service provider facilitating payments, access control, and related platform functionality.

5. Creator Requirements and Verification

If you are a Creator, you represent and warrant that:

• You are at least 18 years old (or legal age of majority) and legally permitted to create and sell Content.

• You have completed all required Verification steps.

• You own all rights to your Content or have all necessary permissions and releases, including from any person appearing in your Content.

• You will not upload Content that violates these Terms or any applicable law.

We may require additional documentation from Creators (including age verification, identity verification, and recordkeeping forms). Failure to provide required documentation may result in restrictions or removal.

6. Content Rules

6.1 You may not post or share Content that:

• Involves minors in any way, including any depiction, suggestion, or implied involvement.

• Depicts or promotes non-consensual sexual content, coercion, exploitation, or violence.

• Includes bestiality, incest content involving real persons, or content that is illegal in your jurisdiction.

• Includes rape, sexual assault, or “forced” roleplay presented as real or non-consensual.

• Depicts self-harm encouragement, threats, or instructions.

• Includes hate speech, extremist content, or targeted harassment.

• Shows doxxing, personal data abuse, blackmail, or extortion.

• Includes illegal activity or instructions to commit crimes.

• Includes unauthorized copyrighted content or content you do not have rights to share.

• Contains malware, phishing links, or harmful code.

6.2 Consent and releases

If your Content includes another person, you must have that person’s explicit consent and legal right to publish and monetize the Content. You must provide proof upon request.

6.3 Moderation

We may remove Content or restrict Accounts at any time if we believe there is a violation, risk, or legal requirement. We are not required to provide notice before removal where safety, compliance, or law enforcement concerns apply.

6.4 Pre-Screening and Review of User-Uploaded Content

PrettyFans requires that all user-uploaded content is reviewed before it is made publicly available on the Platform. This pre-screening process is designed to help ensure that content is not illegal and does not violate these Terms, our community standards, or the requirements of our payment and compliance partners.

What we review: During pre-screening, we may review content, captions, titles, thumbnails, tags, and related metadata to check for prohibited material including (without limitation) content involving minors, non-consensual content, sexual violence, trafficking or exploitation, bestiality, illegal activity, and other violations described in Section 6.1.

How publication works: Content may remain in a pending or “under review” state until the review is completed. Content is not considered approved or published unless and until it is made available on the Platform.

Timing: Review times vary based on volume, account status, risk signals, and the nature of the content. We do not guarantee a specific review timeframe.

Outcomes: After review, we may (a) approve and publish the content, (b) restrict access (including geo-restrictions or age-gating where applicable), (c) require edits or additional verification, or (d) reject and remove the content. If content is rejected, we may also take account actions including warnings, feature restrictions, suspension, or termination, depending on severity or repeat violations.

Ongoing monitoring: Approval through pre-screening does not guarantee that content will remain available. We may re-review content at any time and remove or restrict content that later becomes known to violate these Terms or applicable law.

Anti–Human Trafficking Policy

PrettyFans has zero tolerance for human trafficking, sexual exploitation, forced labor, or any form of coercion or abuse. The Platform is for consenting adults only.

You may not use the Platform to recruit, advertise, facilitate, promote, or profit from human trafficking or exploitation, including (without limitation):

• Sex trafficking, forced sexual activity, or any commercial sexual exploitation

• Forced labor, debt bondage, servitude, or coerced work

• Extortion, blackmail, threats, intimidation, or control of another person’s earnings or account

• Transporting, harboring, providing, obtaining, or soliciting any person through force, fraud, or coercion

• Content involving minors in any way, including any depiction, suggestion, or implied involvement

Reporting trafficking or exploitation

If you believe a person is in immediate danger, contact local emergency services right away.

To report suspected trafficking, coercion, or exploitation on PrettyFans, contact us at support@PrettyFans.co with as much detail as possible, including:

• The username(s) and links to the relevant profile/content

• A description of what you observed and when it occurred

• Any supporting evidence (screenshots, messages, transaction details), if available

Our enforcement actions

We may take any of the following actions at our discretion, without notice where necessary for safety, compliance, or legal reasons:

• Remove or restrict content and features

• Suspend or permanently terminate accounts

• Freeze payouts and investigate related transactions

• Require additional verification and documentation

• Report to and cooperate with law enforcement and relevant authorities

We may preserve and disclose information (including account records, content, and transaction logs) as required by law or to protect users and prevent harm.

7. Intellectual Property and License

7.1 Your ownership

You retain ownership of your Content.

7.2 License to PrettyFans

By uploading Content, you grant PrettyFans a worldwide, non-exclusive, royalty-free license to host, store, reproduce, distribute (only to the extent required to display and deliver Content to authorized users), and display your Content for operating, marketing, and improving the Platform. This includes creating technical copies for streaming, encoding, caching, and content protection.

7.3 PrettyFans’s IP

PrettyFans’s trademarks, branding, software, design, and platform features belong to PrettyFans. You may not copy or reverse engineer the Platform except as permitted by law.

8. Anti-Piracy, Security, and Access Restrictions

You may not download, record, reproduce, redistribute, sell, or share Content outside the Platform unless the Creator explicitly provides permission in writing.

PrettyFans may use access controls such as signed URLs, token-based streaming, watermarking, device/session checks, or other security measures.

Attempts to bypass security, scrape Content, share logins, or provide unauthorized access may result in immediate suspension and legal action.

We may cooperate with rightsholders and law enforcement where appropriate.

9. Payments, Subscriptions, and Purchases

9.1 Purchases

Fans may purchase access to Paid Content through subscriptions, tiers, locked media, paid messages, tips, gifts, or other features.

9.2 Recurring subscriptions

Subscriptions may auto-renew unless canceled before the renewal date. You can cancel at any time through your account settings. Canceling stops future billing but does not automatically refund prior charges unless required by law or explicitly stated.

9.3 Pricing

Creators set their prices, subject to platform minimums, maximums, and policy requirements. PrettyFans may restrict pricing or features for compliance or fraud prevention.

9.4 Fees

PrettyFans charges platform fees and may also pass through payment processing fees, chargeback fees, and taxes where applicable. Your fee breakdown may be shown in your dashboard or transaction records.

9.5 Taxes

You are responsible for any taxes that apply to your purchases (Fans) or earnings (Creators). PrettyFans may collect or withhold taxes where required by law.

10. Refunds, Chargebacks, and Disputes

10.1 General refund policy

Because the Platform provides immediate access to digital content, all sales are generally final once access is granted, unless otherwise required by law.

10.2 Exceptions

We may review refunds in limited cases, such as:

• Unauthorized transactions proven through verification

• Billing errors

• Content not delivered due to a platform technical failure (not user device or connectivity issues)

• Other cases required by law

10.3 Chargebacks

If you file a chargeback without first contacting support, we may restrict your Account, revoke access to purchased content, and recover chargeback fees. Creators may have earnings held or reversed for chargebacks related to their sales.

10.4 Fraud prevention

We may delay access or payouts for fraud checks. This can include temporary holds, enhanced verification requests, or transaction review.

11. Creator Earnings, Payouts, and Holds

Creator earnings may become available for payout after a holding period to manage chargeback and fraud risk. The holding period is typically between 1 and 7 days, depending on account status, payment method, transaction risk signals, disputes, chargebacks, and compliance checks.

Payout timing depends on your payout method, country, verification status, and compliance checks.

PrettyFans may place temporary holds on payouts for suspected policy violations, fraud, disputes, chargebacks, or legal requests.

Creators are responsible for providing accurate payout details. Incorrect details may result in delays or lost funds.

12. Messaging, Community, and Conduct

You agree not to:

• Harass, threaten, stalk, or abuse others

• Blackmail or extort anyone

• Solicit personal data in a harmful way

• Use the Platform to sell illegal goods or services

We may restrict messaging or interactions to protect users and reduce fraud.

13. Account Suspension and Termination

We may suspend or terminate your Account, remove Content, or restrict features if:

• You violate these Terms

• You fail verification

• We suspect fraud or risk to users

• Required by law, regulators, or payment partners

You may stop using the Platform at any time. Some obligations survive termination, including payment obligations, dispute handling, and IP provisions.

14. Appeals

If your Account or Content is restricted, you may appeal by contacting support within 7 days of the action, unless the restriction relates to illegal content, exploitation, minors, or law enforcement matters.

We may request additional information and will review appeals within a reasonable timeframe. Decisions may be final where safety, compliance, or legal obligations apply.

15. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and share data. Where these Terms conflict with the Privacy Policy on data handling, the Privacy Policy controls.

16. Copyright and Takedown Requests

We respect intellectual property rights. If you believe Content infringes your rights, contact us with:

• Identification of the work claimed infringed

• Identification of the allegedly infringing Content (with URLs)

• Your contact information

• A statement of good faith belief and accuracy

We may remove Content and take action against repeat infringers.

17. Third-Party Services

The Platform may integrate third-party services (payment providers, streaming providers, analytics tools, identity verification providers). We are not responsible for third-party services outside our control. Your use of those services may be subject to their terms.

18. Disclaimers

The Platform is provided “as is” and “as available.” We do not guarantee uninterrupted operation, that Content will always remain available, or that access will be error-free.

PrettyFans is not responsible for Creator conduct, Fan conduct, or off-platform interactions.

19. Limitation of Liability

To the maximum extent permitted by law:

• PrettyFans is not liable for indirect, incidental, special, consequential, or punitive damages.

• PrettyFans’s total liability for any claim relating to the Platform is limited to the amount you paid to PrettyFans in the 3 months before the event giving rise to the claim, unless a higher minimum is required by law.

20. Indemnity

You agree to indemnify and hold PrettyFans harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your Content

• Your breach of these Terms

• Your misuse of the Platform

• Your violation of law or third-party rights

21. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of England and Wales, excluding conflict-of-law rules.

Dispute resolution: 
Before filing a claim, you agree to attempt resolution by contacting support and allowing 14 days for informal resolution.

If unresolved, the parties will attempt mediation in good faith for 14 days. Mediation will be conducted in London, England, unless the parties agree otherwise in writing.

If the dispute is still not resolved, it will be finally resolved by arbitration under the LCIA Arbitration Rules in force at the time the arbitration is commenced.

• Binding effect: The arbitral award will be final and binding

Nothing in this section prevents either party from seeking urgent interim or injunctive relief from the courts of England and Wales where necessary to protect rights or prevent irreparable harm.

22. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice on the Platform or by email. Your continued use after changes means you accept the updated Terms.
